Gym Power Purchases &Loyalty Programme
Introduction and Scope
These Terms apply to all transactions and agreements involving Gym Power (operating in association with Express Fitness Urban) and the client (“the Client”).
These Terms specifically cover the purchase of the following products and product lines:
Programme Enrolment and Eligibility
- Enrolment Requirement: To participate in the Gym Power Loyalty Programme and earn credits, Clients must formally sign up and register an account.
- Acceptance of Terms: By enrolling in the programme, the Client acknowledges that they have read, understood, and agreed to be bound by these full Terms and Conditions.
- Welcome Pack: Upon successful enrolment, the Client will be provided with a Welcome Pack detailing the programme rules, guidelines, and reward tracking mechanisms.
Pricing and Payment Terms
- Taxation: All prices quoted are inclusive of Value Added Tax (VAT) unless explicitly stated otherwise.
- Upfront Payment: An upfront payment of 100% of the total order value is required to confirm any order. No manufacturing or procurement will commence until full payment has cleared.
- Payment Methods: Payments must be made via Electronic Funds Transfer (EFT), direct bank transfer, or any other pre-approved payment method explicitly authorised by Gym Power.
- Retention of Title: Ownership and legal title of the goods shall remain exclusively with Gym Power and shall not pass to the Client until Gym Power has received full payment in cleared funds for the said goods.
Gym Power Loyalty Programme
- Earning Rate: Clients earn a flat 2.5% loyalty credit on the total eligible purchase value.
- Product Eligibility: Loyalty credits are strictly limited to, and earned only on, the specific Gym Power equipment lines listed in Section 1 of this document.
- Credit Validity: Earned loyalty credits are valid for a period of twelve (12) months from the date of issuance. Any unused credits will automatically expire after this period.
- Restrictions: Loyalty credits are non-transferable, cannot be redeemed or exchanged for cash, and cannot be applied to any products or services outside the designated Gym Power range.
- Redemption: Credits may only be redeemed against subsequent purchases of additional eligible Gym Power equipment within this programme.
Delivery, Installation, and Timelines
All products are supplied Ex-Works (EXW) from the Express Fitness Urban (EFU) warehouse.
Any delivery, freight, or installation services are excluded from the base product price and will be costed and invoiced separately once the product has arrived at the EFU warehouse.
Estimated processing and production duration calculated from the formal order confirmation date.
Estimated freight duration calculated from the successful completion of the equipment manufacture.
Warranty, Inspection, and Liability
- Warranty Coverage: The standard manufacturer’s warranty applies to all eligible products. Specific warranty periods and inclusions will be provided with the product documentation.
- Defect Reporting: Clients are required to thoroughly inspect all products upon delivery. Any defects, damages, or discrepancies must be reported in writing to Gym Power within ten (10) business days of delivery.
- Limitation of Liability: Gym Power, its directors, and associates shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of business, revenue, or profit, arising from the supply, delivery, installation, or use of the equipment.
Cancellations, Refunds, and Termination
Gym Power reserves the right to terminate a Client’s loyalty account and forfeit any accrued loyalty credits if the Client breaches any part of these Terms and Conditions.
Miscellaneous Provisions
- Governing Law: These Terms, and any dispute arising from them, shall be governed by, construed, and enforced in accordance with the laws of the Republic of South Africa.
- Amendments: Gym Power reserves the right to amend, update, or modify these Terms and Conditions at any time. Material changes will be communicated to active programme participants with reasonable notice.
- Communication Channels: Official communications regarding orders, loyalty credit updates, notices, and invoices may be transmitted via email, telephone, or WhatsApp using the contact details provided by the Client upon registration.
